Naturalisation

Austria: citizenship in the special interest of the Republic

Austria has no citizenship-by-investment programme. Its Citizenship Act does, however, allow the Federal Government to approve naturalisation, without the usual residence requirements, where a person's extraordinary achievements, including economic contributions, are in the special interest of the Republic.

Overview

Ordinary Austrian naturalisation under Section 10(1) of the Citizenship Act requires long lawful residence, German language skills, integration, financial self-sufficiency, an unblemished record and, as a rule, renunciation of any prior nationality. Section 10(6) creates a narrow exception: several of these requirements may be set aside where the Federal Government confirms that naturalisation is in the special interest of the Republic because of the person's extraordinary achievements already made and still expected.

Such achievements may lie in science, the arts, sport or the economy. In the economic sphere, Austrian practice looks for contributions that clearly exceed the ordinary and bring visible added value to the country, such as building substantial operating businesses, creating jobs, transferring technology or carrying out structurally significant projects. There is no published investment amount, and Austrian advisers emphasise that a transfer of capital on its own, or a distinguished international reputation without concrete benefit to Austria, will not suffice.

The procedure runs through the competent provincial government, with security assessments and the involvement of the relevant federal ministries, before the Federal Government takes its decision. Because it is a political act of discretion, the Federal Government's decision on the special interest cannot be appealed, and timelines are not prescribed. Unlike ordinary naturalisation, the route does not generally require renunciation of a prior nationality, although the applicant's other country may have its own rules.

The April 2025 judgment of the Court of Justice of the EU in Commission v Malta held that granting citizenship in exchange for predetermined payments is incompatible with EU law. Austria's route is structurally different because it has no standardised acquisition mechanism, but the ruling reinforces a cautious, merit-led approach. Families should therefore view Section 10(6) as recognition of a genuine, documented relationship with Austria rather than as a transaction.

How Legal Wealth helps

Legal Wealth approaches Austria with candour. We do not market Section 10(6) as a purchasable programme, and we will say so where a case is unlikely to succeed. Where a client has, or genuinely intends to build, a substantial presence in Austria, we work with licensed Austrian lawyers to plan that activity on its commercial merits, assemble a rigorous and transparent dossier, and manage the process discreetly. We also consider alternatives, including Austrian residence, and how any outcome fits the family's tax position and long-term succession planning.

Frequently asked questions

Can I buy Austrian citizenship?

No. Austrian law has no investment programme or fixed price. Section 10(6) recognises extraordinary achievements and requires a political decision by the Federal Government.

Is there a minimum investment?

No amount is set in law or published. Capital transfer alone, without concrete benefit to Austria, is not regarded as sufficient.

Can I keep my current nationality?

Generally yes. The usual requirement to renounce a prior nationality can be waived under Section 10(6), but you should confirm that your current country also permits dual nationality.

How long does it take?

There is no statutory timeline. Once a credible case exists, the procedure itself commonly takes between one and three years.

Did the 2025 CJEU Malta ruling affect Austria?

The ruling targeted citizenship granted for predetermined payments. Austria's merit-based, discretionary route is structurally different, but it reinforces a cautious approach.
