Crypto business in Bosnia and Herzegovina

Bosnia and Herzegovina does not yet have a dedicated licensing regime for crypto-asset service providers. Regulation is shaped by a state-level anti-money-laundering framework and by entity-level capital market authorities, and the Federation of Bosnia and Herzegovina is preparing its first law on virtual asset service providers. We help clients navigate this transitional landscape and position for the regime that is coming.

Overview

Bosnia and Herzegovina has a layered constitutional structure: the state, two entities (the Federation of Bosnia and Herzegovina and Republika Srpska) and Brčko District. Anti-money-laundering legislation is set at state level, while securities and capital markets are regulated separately by each entity and by Brčko District. As a result, there is no single national crypto licence, and the rules a business faces depend on where it is established and what it does.

At present no entity operates a dedicated licensing regime for crypto-asset service providers. Businesses must instead comply with the state-level Law on Prevention of Money Laundering and Financing of Terrorist Activities and assess whether their products touch securities, payments or foreign exchange rules. The Federation's Securities Commission issued a public warning in 2023 about the risks of buying digital assets through unauthorised channels, which illustrates the cautious stance of local authorities.

Change is under way. In 2026 the Federation launched a capital market reform package that includes a draft Law on Providers of Services Related to Virtual Assets and Cryptocurrencies, intended to regulate crypto for the first time, introduce supervision and protect users, in line with EU standards. The drafts were placed in public consultation with the aim of sending them to the legislative procedure in September 2026. Separately, in October 2026 the Council of Ministers formed a working group with a six-month mandate to amend the state AML law to meet MONEYVAL and FATF recommendations.

For now, Bosnia and Herzegovina suits groups with a genuine local operational reason to be there, such as development teams or regional customer support, rather than as a primary licensing base. We recommend a structure that can be brought quickly into the forthcoming regime, combined where necessary with a licence in an established jurisdiction.

Frequently asked questions

Is there a crypto licence in Bosnia and Herzegovina?

Not yet. No dedicated licensing regime for crypto-asset service providers was in force as of October 2026, although the Federation is preparing a law on virtual asset service providers.

Which authority would supervise crypto businesses?

AML rules are set at state level, while capital markets are supervised separately by the Federation and Republika Srpska securities commissions and in Brčko District. The Federation draft law will define supervision for its territory.

When will the Federation law be adopted?

The drafts were in public consultation in 2026 with the aim of entering the legislative procedure in September 2026. Adoption timing depends on the parliamentary process.

Do AML rules apply to crypto businesses now?

Businesses should assume they must meet AML/CFT standards. The state AML law is also being revised, with a working group formed in October 2026 to address MONEYVAL and FATF recommendations.

Can a local company serve EU clients?

No. Bosnia and Herzegovina is not in the EU, so serving EU clients requires MiCA authorisation in a member state.
